Terms of use

By downloading and using Sjekkbok you accept the terms below. They are written to be readable. The app itself is in Norwegian.

What you get

You receive a personal, non-exclusive right to use the app on devices you control, in line with Apple's Standard End User License Agreement for Licensed Application. The app is licensed, not sold. You may not resell, decompile or modify it, or distribute it outside the App Store.

Subscription

Sjekkbok is used with a subscription, either monthly (NOK 249) or yearly (NOK 1,999). The first time you subscribe, you get 14 days free. Cancel before the trial ends and nothing is charged.

The subscription is bought through the App Store and charged to your Apple ID. It renews automatically for the same period and price unless you cancel at least 24 hours before the period ends. You cancel under Settings → your name → Subscriptions on your iPhone or iPad. After cancelling, you keep access for the rest of the period you have paid for.

With a subscription you can create projects and checklists, set statuses, take photos, record deviations and changes, sign, send to the client, and adapt templates and QA procedures. Without one — before you start, or after it has ended — you can still read everything, share reports and checklists as PDF, make a backup and import a backup. Your content is never locked away.

If the price changes, Apple notifies you before the new price applies, and a price increase usually has to be accepted before the subscription renews.

Your content is yours

Everything you enter into the app belongs to you or your company. The publisher claims no rights to it and has no access to it. Keeping your own data safe is your responsibility, through the app's backup or a backup of the device.

The app does not assess

Sjekkbok records and organises what you enter yourself. The status of a point is the user's statement, not the app's. The app takes no position on whether the work or the documentation is correct, complete or sufficient under any law, regulation, standard or contract, and it does not give advice.

The standard templates take the Norwegian building application regulations (SAK10) as the starting point for which points they contain. They are a starting point for the company's own checks, not an assessment of them. The same goes for the QA procedures that come with the app: once the company adopts them, they are the company's own.

Documentation produced with the app does not replace professional judgement, design work, inspection or any other duty the company carries. Professional responsibility, and responsibility for how the documentation is used, rests with the company.

Sending to the client

Notices and change notifications are sent from your own email or SMS. The app assembles the text and the PDF; you decide the content, the recipient and when it is sent, and you are responsible for it. The app sends nothing itself and does not know whether a message has arrived.

Acceptable use

You agree to use the app within applicable law, and not to enter content you have no right to process. If you enter information about other people, you or your company is the party responsible for that processing.

Availability and changes

The app is provided as is. The publisher aims to fix defects and keep the app running on new iOS releases, but does not promise error-free operation, the continued presence of any particular feature, or continued availability in the App Store. Features may change or be removed in later versions.

Limitation of liability

The publisher is not liable for indirect loss, consequential damage, lost profit or lost data arising from use of the app. Liability is in any case limited to the amount you have paid for the app in the preceding twelve months. This limitation does not apply to loss caused by gross negligence or intent, and does not restrict mandatory rights you hold as a consumer.

Purchases, right of withdrawal and refunds

All purchases are made with Apple and follow Apple's terms. Refunds and the right of withdrawal are handled by Apple at reportaproblem.apple.com. The publisher can neither see individual purchases nor process refunds.

Privacy

How the app handles data is set out in the privacy policy, which forms part of these terms.

Changes to these terms

These terms may be updated. A new version is published here with a new date and applies from that date. Continued use of the app after that counts as acceptance.

Governing law and venue

These terms are governed by Norwegian law. Disputes are to be resolved amicably where possible. Failing that, the publisher's place of business is the agreed venue, unless you are a consumer and mandatory rules give you a different right.
