Terms of use

By downloading and using TrenchDocs you accept the terms below. They are written to be readable.

What you get

You get a personal, non-exclusive right to use the app on devices you control, under Apple's standard Licensed Application End User License Agreement. The app is licensed, not sold. You may not resell, decompile or modify it, or distribute it outside the App Store.

Subscription

TrenchDocs is used with a subscription, either monthly or yearly. In Norway it costs NOK 249 a month or NOK 1,999 a year; in other countries the App Store shows the price in your own currency before you buy. The first time you subscribe, you get 14 days free. Cancel before the trial ends and nothing is charged.

The subscription is bought through the App Store and charged to your Apple ID. It renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. You cancel under Settings → your name → Subscriptions on your iPhone or iPad. After cancelling, you keep access until the end of the period you have paid for.

With a subscription you can record new projects and trenches and change what has been recorded: the line, the installations, the depths, the photos and the backfill. Without one — before you start, or after it has ended — you can still read everything, make the report, export, make a backup and import it again, and delete. What you have recorded is yours either way.

If the price changes, Apple notifies you before the new price applies, and for a price increase you usually have to accept it before the subscription renews.

Your content is yours

Everything you enter in the app belongs to you or your company. The publisher makes no claim to it and has no access to it. You are responsible for keeping your own data safe, for example with the app's backup or a backup of the device.

The app records, it does not assess

TrenchDocs records what you enter and puts it together as a report and exports. It takes no view on whether a depth, a fall, the backfill or any other work has been done as it should be under laws, regulations, standards, the excavation plan or contracts. It calculates no volumes and gives no advice.

The list before backfilling counts only what has been recorded. A tick means something is recorded, not that it is enough or good enough.

Positions in the app are what the phone reports, with the uncertainty the phone itself reports. They are not a survey and must not replace surveying where surveying is required. The cross-section of the backfill is schematic and not to scale.

Records made with the app do not replace professional judgement, design, utility locating, inspection or any other duty you or your company have. Professional responsibility, and responsibility for how the records are used, rests with you or your company.

Map data

The map in Norway comes from the Norwegian Mapping Authority (© Kartverket, CC BY 4.0), and the app also uses Apple's maps. The maps show roughly where things are; they do not show cables, pipes or other lines in the ground, and they do not replace utility locating.

Using the app

You must use the app in line with applicable law, and not enter content you have no right to process. If you enter information about other people, you or your company are responsible for that processing.

Availability and changes

The app is provided as is. The publisher aims to fix bugs and keep the app working on new iOS versions, but does not promise error-free operation, particular features over time, or that the app will stay available in the App Store. Features may change or be removed in new versions.

Limitation of liability

The publisher is not liable for indirect loss, consequential loss, lost profit or lost data arising from use of the app. Liability is in any case limited to the amount you have paid for the app in the last twelve months. This limitation does not apply to loss caused by gross negligence or wilful misconduct, and it does not restrict mandatory rights you have as a consumer.

Purchases, cancellation rights and refunds

All purchases are made with Apple and follow Apple's terms. Refunds and statutory cancellation rights are handled by Apple at reportaproblem.apple.com. The publisher can neither see individual purchases nor process refunds.

Privacy

How the app handles data is set out in the privacy policy, which forms part of these terms.

Changes to the terms

These terms may be updated. A new version is published here with a new date and applies from that date. Continued use of the app after that counts as acceptance.

Governing law and venue

These terms are governed by Norwegian law. Disputes are to be settled amicably where possible. If that fails, the publisher's place of business is the venue, unless you are a consumer and mandatory rules give you the right to something else.
